TERMS OF SERVICE




Thank you for visiting COMMON AREA HONG KONG SAR website on www.commonarea.com.hk (the “Site”).  Access to and use of the Site and related services (collectively, the “Services”) are made available to you in accordance with the following Terms of Service and any other policies posted on the Site, including the Privacy Policy (collectively, the “Terms of Service”). 

 

By using the Site or requesting to use any of the Services, (i) you confirm that you have read and understood COMMON AREA Terms of Service and you agree to be bound by and to comply with them (ii) you consent in particular to COMMON AREA processing any personal data it collects from you or that you have provided to COMMON AREA, and you warrant that all data provided by you is accurate (iii) we will use, store and disclose any personal data provided by you in accordance with the Privacy Policy.

 

COMMON AREA reserves the right to make changes to the Site or any part of the Terms of Service at any time. Please visit this page from time to time to check for any updates or changes to any part of the Terms of Service.

 

 

To place orders with COMMON AREA HONG KONG, you must meet our conditions of eligibility:

1.      1 | Be aged 18 years of age or over

2 | Be in possession of a valid credit card issued by a licensed bank 

3 | Providing personal and payment details that are warranted by you to be both valid and accurate (email address, real name, phone number, billing and delivery information and other requested information as indicated)


In placing an order with us, you authorize COMMON AREA HONG KONG to process a charge or charges on your credit account in the amount of the total purchase price of your order. You also authorize us to use personal information provided by you to perform appropriate anti-fraud checks such as credit checks and also to, where necessary, transmit or obtain information about you to or from third parties including, but not limited to, credit reference or fraud-prevention agencies, which may keep a record of that information. 

 

DESCRIPTION OF GOODS AND SERVICES | COMMON AREA HONG KONG will endeavor to ensure that the content and the product descriptions on the Site are as accurate and complete as possible. We however do not warrant that content and product descriptions are accurate, complete, current or error-free.

 

 

PAYMENT | We accept payments made by Visa, MasterCard, American Express and Apple Pay. By placing an order using one of the above payment methods, you confirm that the card account used is yours or that you have been authorized by the owner to use it. If your card issuer refuses to authorize payment, we will not be liable for any delay or non-delivery.  Our payment processes meet the stringent international security standards set down by the payment card Industry to make your shopping experience safe and secure. 

 

 

PRICING | Prices are shown on the Site in Hong Kong Dollars (HKD).  You will be able to preview the price in your local currency based on the rates obtained from www.xe.commost currencies are listed under the top menu bar for your viewing.

Prices displayed on the Site at the time your order is accepted will be honored except in the case of obvious error. Whilst we use our best endeavors to ensure that all prices appearing on the Site are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors. If we discover an error in the price of any products that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming or cancelling your order. If we are unable to contact you, we will treat the order as cancelled.

If your payment card is not denominated in Hong Kong Dollars (HKD), the final price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

 

ACCEPTANCE OF ORDER | All orders are subject to stock availability and confirmation of the order price. COMMON AREA reserves its right not to accept an order for any reason in its sole discretion including but not limited to any of the following reasons:


1 | The product you ordered is out of stock, or is withdrawn by the company or its Consignor 

2 | We are unable to accept your order due to a system error

3 | We are unable to obtain authorization for payment

4 | You do not meet the eligibility criteria to purchase as set out in these Terms Of Service


Our Customer Service team will contact you as soon as possible if we are unable to accept your order.

 

SHIPPING & DELIVERY | We will ship on a Delivery Duty Unpaid (DDU) basis and customer will only be charged for the price of the product(s) purchased (excluding taxes and duties) and the delivery costs. Customers will be responsible for the payment of all import tax and duties levied by the country to which the products are shipped and payment of the said tax and duties is necessary for the release of the products ordered from the Customs on arrival. Our courier for overseas customer, DHL, will contact customers about the details of any import duty to pay. We advise you to contact your local customs authority to determine the cost of import tax and duties of your order prior to your placing orders with us.  Please be aware that if you decline to pay these charges, the shipment will automatically be returned to us and we will then deduct any related charges incurred from the refunded amount of your original purchase.  Orders within Hong Kong SAR are not subject to taxes and duties.


We endeavor to dispatch all products except pre-order or customized items within 1-3 working days after the order has been placed and payment confirmed.  If the item is to be shipped to an address outside Hong Kong, shipping times may vary.  Orders received on Friday – Sunday and Public Holidays will be processed within 1-2 days after work resumes.  

 

You are responsible for ensuring that the order placed can be delivered to the address provided by you when placing your order.  If the first attempt of delivery is unsuccessful, you shall be liable for any additional costs incurred for each additional delivery attempt.

 

You need to sign a confirmation of receipt of the products when the products are delivered and by doing so you accept the responsibility for the products ordered from that moment on. If the recipient or collector is not the original purchaser, or in case of delivery of a gift, then you accept that signature of the recipient or collector is evidence of delivery and fulfilment of your order by COMMON AREA. 


PRE-ORDER ITEMS All orders are subject to stock availability, pre-order items will be submitted to the supplier after full payment is completed.  However, due to the high demand for some items or on the occasions of short shipment by the manufacturer, we will contact you to arrange for immediate refund.


The actual release date of the pre-ordered goods depends on the final decision of the supplier/manufacturer, this applies mostly to some of the art toys.  Please understand that these factors are not within the control of the company.  Shipments may also be further delayed due to COVID lockdown, please bear with us on any order delay during such critical period. 


If the pre-ordered product is still not shipped by the manufacturer within 6 months after the stated release date, please contact us to discuss your options.


PRODUCT PACKAGING | Product packaging and carton boxes are used solely for the purpose of packaging and delivery and is not a part of the product, and thus will not be considered damaged in case the packaging is not in its perfect condition.   We strive to offer you the best service and quality products, nevertheless, the handling of product during shipment is beyond our control.  Please understand there there no refund, return or exchange related to imperfection of packaging or delivery boxes will be entertained. We appreciate your understanding.


RETURN, REFUND & EXCHANGE POLICY | All items purchased, including pre-order items, are final sale, no exchange, refund and return can be provided unless product is considered by the Company and/or its manufacturer as broken or damaged.  Thank you.


In case of damaged products, please refer to the below return procedures.

 

1 | Customers will take full responsibility for the returns, including the shipping fee

2 | We reserve the right to refuse returns that are not properly packed or any of the tags, certificates, warranties, care instructions, product labelling, authenticity cards, extra buttons, hangers, dust bags and boxesas stated above have been removed or missing

3 | COMMON AREA reserves the right to refuse returns that are delivered in poor condition.  Should the returned item be deemed not to be in its original condition, COMMON AREA reserves the right to return the item to the sender at the sender’s cost.   For overseas purchase, the sender will be responsible for all taxes and or duties imposed by the customs authorities for any return of goods to COMMON AREA

4 | COMMON AREA does not accept any responsibility for loss or damage to returned goods whilst in transit

5 | Initial shipping, taxes and duties involved with the return/refund or exchange item(s) will not be refunded

6 | Please note that refunds can take up to 20-30 working days to show on your account due to the varying processing times between payment card providers 

7 | Your refund will be credited to the original payment card

8 | In the case of exchange and the possibility of sold out/out of stock, your requested exchange will be carried out through a refund or exchange to another product of the same or higher price from the same Consignor and customers will need to settle the difference between the prices of the merchandises

9 | If you have enjoyed a promotional offer/discount for the item that needs to be exchanged, and the promotional period already expired at the time of your exchange request, we will not be able to provide the same offer for the new item

10 | Since special promotion, offer and discount are provided by different Consignors, the exchange of product where applicable, shall be restricted to the goods offered by the same Consignor only

11 | COMMON AREA and its Consignor(s) reserves the right to make the final decision on all return, refund and exchange requests.
