TERMS OF SERVICE

Thank you for visiting COMMON AREA HONG KONG SAR website on www.commonarea.com.hk (the “Site”).  Access to and use of the Site and related services (collectively, the “Services”) are made available to you in accordance with the following Terms of Service and any other policies posted on the Site, including the Privacy Policy (collectively, the “Terms of Service”). 

By using the Site or requesting to use any of the Services, (i) you confirm that you have read and understood COMMON AREA Terms of Service and you agree to be bound by and to comply with them (ii) you consent in particular to COMMON AREA processing any personal data it collects from you or that you have provided to COMMON AREA, and you warrant that all data provided by you is accurate (iii) we will use, store and disclose any personal data provided by you in accordance with the Privacy Policy.

COMMON AREA reserves the right to make changes to the Site or any part of the Terms of Service at any time. Please visit this page from time to time to check for any updates or changes to any part of the Terms of Service.

INTELLECTUAL PROPERTY | All content (which is defined as, or includes, any text, audio or music, video, graphics, photographs, and image) are the intellectual property of COMMON AREA HONG KONG and its consignors or manufacturers and are protected by intellectual property and copyright laws.

ELIGIBILITY TO PURCHASE | To place orders with COMMON AREA HONG KONG, you must meet our conditions of eligibility

Be aged 18 years of age or over

Be in possession of a valid credit card issued by a licensed bank

Providing personal and payment details that are warranted by you to be both valid and accurate (email address, real name, phone number, billing and delivery information and other requested information as indicated)

In placing an order with us, you authorize COMMON AREA HONG KONG to process a charge or charges on your credit account in the amount of the total purchase price of your order. You also authorize us to use personal information provided by you to perform appropriate anti-fraud checks such as credit checks and also to, where necessary, transmit or obtain information about you to or from third parties including, but not limited to, credit reference or fraud-prevention agencies, which may keep a record of that information. 

DESCRIPTION OF GOODS AND SERVICES | COMMON AREA HONG KONG will endeavor to ensure that the content and the product descriptions on the Site are as accurate and complete as possible. We however do not warrant that content and product descriptions are accurate, complete, current or error-free.

PAYMENT | We accept payments made by Visa, MasterCard, American Express, FPS and Alipay. By placing an order using one of the above payment methods, you confirm that the card account used is yours or that you have been authorized by the owner to use it. If your card issuer refuses to authorize payment, we will not be liable for any delay or non-delivery.  Our payment processes meet the stringent international security standards set down by the payment card Industry to make your shopping experience safe and secure. 

PRICING | Prices are shown on the Site in Hong Kong Dollars (HKD).  You will be able to preview the price in your local currency based on the rates obtained from www.xe.commost currencies are listed under the top menu bar for your viewing.

Prices displayed on the Site at the time your order is accepted will be honored except in the case of obvious error. Whilst we use our best endeavors to ensure that all prices appearing on the Site are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors. If we discover an error in the price of any products that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming or cancelling your order. If we are unable to contact you, we will treat the order as cancelled.

If your payment card is not denominated in Hong Kong Dollars (HKD), the final price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

ACCEPTANCE OF ORDER | All orders are subject to stock availability and confirmation of the order price. COMMON AREA reserves its right not to accept an order for any reason in its sole discretion including but not limited to any of the following reasons:

1 | The product you ordered is out of stock, or is withdrawn by the company or its Consignor 

2 | We are unable to accept your order due to a system error or error in product description and pricing

3 | We are unable to obtain authorization for payment

4 | You do not meet the eligibility criteria to purchase as set out in these Terms Of Service

Our Customer Service team will contact you as soon as possible if we are unable to accept your order.

SHIPPING & DELIVERY | We will ship on a Delivery Duty Unpaid (DDU) basis and customer will only be charged for the price of the product(s) purchased (excluding taxes and duties) and the delivery costs. Customers will be responsible for the payment of all import tax and duties levied by the country to which the products are shipped and payment of the said tax and duties is necessary for the release of the products ordered from the Customs on arrival. Our courier for overseas customer, DHL, will contact customers about the details of any import duty to pay. We advise you to contact your local customs authority to determine the cost of import tax and duties of your order prior to your placing orders with us.  Please be aware that if you decline to pay these charges, the shipment will automatically be returned to us and we will then deduct any related charges incurred from the refunded amount of your original purchase.  Orders within Hong Kong SAR are not subject to taxes and duties.

We endeavor to dispatch all products except pre-order or customized items within 1-3 working days after the order has been placed and payment confirmed.  Orders received on Friday – Sunday and Public Holidays will be processed within 1-2 days after work resumes.  

You are responsible for ensuring that the order placed can be delivered to the address provided by you when placing your order.  If the first attempt of delivery is unsuccessful, you shall be liable for any additional costs incurred for each additional delivery attempt.

You need to sign a confirmation of receipt of the products when the products are delivered and by doing so you accept the responsibility for the products ordered from that moment on. If the recipient or collector is not the original purchaser, or in case of delivery of a gift, then you accept that signature of the recipient or collector is evidence of delivery and fulfilment of your order by COMMON AREA. 

RETURN & EXCHANGE | Unless otherwise stated, this Return & Exchange Policy applies to both in-store and online purchases.

1 | No Return, Exchange or Refund for promotions and sale items, pre-order, personalized, made to order or excluded items as stated by individual Consignor of Common Area.  Return policy applies for all other item that is unused and in its original condition, please contact us within 7 days of purchase.

 2 | For Consignor’s products that are eligible for refund or exchange, COMMON AREA will assist to contact the Consignor for the necessary examination, refund or exchange.

NOTICES AND WRITTEN COMMUNICATIONS

Any requests and notice to COMMON AREA must be in writing and sent by email to customerservice@commonarea.com.hk.
